THE DOMESTIC GROSS SALARY IN 2024

The domestic minimum basic gross salary in 2024 will amount to 3,300 lei (around 663 €) per month, except for the constructions and agriculture sectors where it will be 4,582 lei and 3,436 lei, respectively.

The Decision of the Government no. 900/28.09.2023 concerning the domestic minimum basic gross salary was published in the Official journal no. 877 of September 28, 2023. Under the decision, the domestic monthly minimum gross wage of 3,000 lei has been raised to 3,300 lei since October, for normal working hours of 165,333 hours/ month, corresponding to an hourly salary of 19,960 lei (around 4 €).

The minimum gross salary for the sectors of constructions and agriculture has been established under the Government Ordinance no. 93/2023, in force since November 2023.

Thus, in the construction sector, the minimum basic monthly gross salary amounts to 4,582 lei (921 €), corresponding to an hourly salary of 27,714 lei. This minimum gross salary applies exclusively to the fields of activity (the CAEN codes) provided under article 60 point 5 of the Fiscal Code.

The minimum gross basic monthly salary in agriculture amounts to 3,436 lei (691 €), meaning an hourly salary of 20,782 lei. This minimum gross salary applies exclusively to the fields of activity provided under article 60 point 7 of the Fiscal Code.

The minimum wages enacted under the Ordinance no. 93/2023 are free of bonuses, allowances and other advantages that the employees of the two sectors may benefit of.

It should also be noted that starting with October 2023, under the newly adopted law no. 296/2023, the exemption of payment of the CASS (contribution to the social insurance fund) for the employees in the constructions, agriculture and food industry is no longer in force.

Any infringement by the employers of the provisions relating to the minimum wage is deemed contravention and is subject to the penalties provided under the article 260 paragraph (1) letter a) of the law no. 53/2003 (fine amounting to between 300 and 2,000 lei).

Finally, under the article 164 of the Labor Code, as modified by the GEO no. 142/2021, starting with January 1st, 2022, an employee (hired after January 1st, 2022 can be paid the minimum salary for a term of maximum 24 months. The 24 months passed, the employer must increase the gross basic salary to an amount that the minimum is not provided under the law.

Considering that this is a modification mandatory under the law (the increase of the minimum wage), according to article 17 paragraph 5 of the Labor Code, it is not required to execute an addendum to the employment contract to provide therefor.
