RETAILERS’ OBLIGATIONS: CREATION OF THE EMPLOYEES ’ PERSONAL CASH LEDGER


Our latest article, published on April 30, informed you on the taxation of tips and on the retailers’ obligation to issue a separate receipt for tips paid by their clients. In order to make a difference between the money cashed as tips and the employees’ personal money and to ensure, therefore, the actual taxation of tips, Emergency Ordinance no. 8/2015 set forth the retailers’ obligation to create and keep the employees’ Personal Cash Ledger. Given that the model of the Ledger was approved by the Order of the Ministry of Finance no. 513/2015 (published in the Official Journal no. 300 of April 30, 2015), our present article contains a brief presentation of the aspects related to this Ledger and of the retailers’ obligations.


RETAILERS' OBLIGATIONS


Retailers selling goods, as well as service suppliers must keep the employees’ Personal Cash Ledger at the place where they carry out their activities. This Ledger must be signed by the retailer’s director or by his proxy and it must be filled-in daily by the employees, who have to declare any money they have on them at the beginning of their work hours.

Any amount of money that was not registered in the Ledger at the beginning of the work hours or registered afterwards will not be considered as personal money and retailers risk receiving a civil sanction which can lead, in certain cases, to the suspension of their activity and to a maximum fine of 27,500 Lei (if the unjustified amount exceeds 1,000 lei and 3% of the total value of the goods or services recorded in the electronic memory of the cash registry when the inspection is being performed).

As of May 8, retailers are obliged to notify the competent tax authority of the creation of the Personal Cash Registry, by also indicating the date of its creation and the number of pages. Thus, the retailer is obliged to keep the Ledger at its headquarters and present it in case an inspection is performed.Retailers has to make sure that the Ledger is correctly and consistently filled-in, without amendments/deletions and without blank spaces.


CONTENTS OF THE LEDGER


The Ledger will comprise the following information:


  • Date: day, month, year

  • First and second names of the employee

  • Position

  • Amount of money held at the beginning of the hours

  • Hour of registration

  • Employee’s signature
