Gruia Dufaut & Asociații wins in court, in appeal, a file regarding the dissolution of the Association Salvați Bucureștiul, lodged by One Properties. The decision rendered by the Bucharest Court on March 20 is final.
The 5th district Court House had originally admitted, in 2023, the request for dissolution of the NGO, filed by One Properties, on grounds of alleged insolvency, following an attempt of enforced recovery by the company against the Association.
The Gruia Dufaut și Asociații team, made of Teodora Koletsis, Partner, and Laura Marinescu-Ioniță, Senior Associate, provided assistance and representation for the Association only in the stage of the appeal.
“This decision of the Court comes to strengthen the caselaw with respect to the possibility for appellate courts to find the inexistence of the debts of an association / foundation and unfulfillment of the conditions for dissolution, despite of a dissolution decision rendered by a lower court”, declared Teodora Koletsis.
