EXTENDED DEADLINE FOR FILING TAX STATEMENTS

In line with its usual practice, the Romanian Government amended again the Tax Code, this time by Emergency Ordinance no. 8/2016 (published in Official Journal no. 225/25.03.2016, in force as of 25.03.2016). The said Ordinance extended the deadline for filing certain tax statements and provided the obligation of taxpayers who withdrew their vehicles from circulation until December 31, 2015 to submit a tax statement prior to the deadline, which will be in May. The amendments brought by OUG no. 8/2016 are presented to you hereinafter.


FILING TAX STATEMENTS


For 2016, the deadline for the payment of the first instalment of the tax on buildings, vehicles or lands was extended until June 30, 2016, whereas payment of such tax was normally made until March 31, 2016.
Taxpayers who pay the entire tax until June 30, 2016 can benefit from a discount up to 10% of the amount of the tax; however, the exact amount of such discount will be established by each Local Council.

In accordance with OUG no. 8/2016, legal persons have to file, until May 31, 2016, a tax statement referring to the buildings they owned on December 31, 2015 and also state the destination and taxable value of such buildings.

Moreover, natural persons who owned buildings – whether non-residential or mixed use – on December 31, 2015 must file a tax statement until May 31, 2016, based on a standard format to be approved by order of the Minister of Public Finance.


VEHICLES WITHDRAWN FROM CIRCULATION


Taxpayers who withdrew their vehicles from circulation until December 31, 2015 (Attention: this refers to deregistration from the Police database, and not from the tax registries) must submit a tax statement, accompanied by supporting documents, to the specialized services of the public local administration (tax units) until May 31, 2016.
