DRIVING LICENSE : NEW RULES ON HOW TO PROVE DOMICILE AND RESIDENCE ...
On September 18, we provided you with a presentation of the amendments brought by Ordinance no. 21/2014 on the procedures to be followed by foreign citizens in order to obtain their driving licenses. The purpose of this Ordinance was to transpose more accurately and more correctly Directive no. 2006/126/EC and to broaden the scope of the terms “residence” and “domicile”, so as to allow foreign citizens residing in Romania to pass the driving license exam.
By Order no. 173/2014 (Official Journal no. 879 of December 2, 2014), the Ministry of Internal Affairs amended Order no. 268/2010 regarding the procedures for obtaining a driving license and made several mentions regarding the means available to foreign citizens in order to obtain their driving license, the documents that they must submit in order to prove their residence/domicile in Romania, as well as regarding the authority competent to examine such proof. These amendments are presented to you hereinafter.
THE AUTHORITY COMPETENT TO EXAMINE CANDIDATES
As regards the examination of candidates wishing to obtain a driving license, the competence for such examination belongs to the public community service in whose jurisdiction the candidate has his/her residence/domicile or address – (for candidates who study in Romania, but do not have their residence/domicile here). Nevertheless, candidates with physical disabilities can be examined by the public community service in whose jurisdiction their Driving School is located.
Foreign citizens wishing to obtain a driving license must make a sworn statement certifying the fact that they live in Romania at least 185 days per year.
PROOF OF DOMICILE OR RESIDENCE
The proof of domicile or residence on Romanian territory is made by presenting valid identity papers, certifying the fact that the candidate’s address in located in the jurisdiction of the territorial public community service issuing the driving license.
If domicile or residence cannot be proved by such documents, candidates can prove domicile / residence by other documents justifying, in relation to an address, certain facts, such as the candidates’ presence at such address, as well as the presence of their families thereat, the existence of a housing made available to them, the place where they carry out their professional activities, the place where their children study, the place where their property interests are located or the place of their administrative links with the public authorities and institutions.
