A new range of restrictions aimed at better fighting against the coronavirus have been adopted in Romania under the Military Ordinance issued by the Ministry of Internal Affairs no. 2/2020, published din the Official Gazette no. 232 from March 21, 2020 further to the sanitary emergency decreed in the context of the current COVID-19 pandemic outbreak.
Here below, there are the main measures adopted:
The free movement of persons
- During the emergency state, groups of more than 3 persons (who do not live together) are banned from public domain;
- As a recommendation : movement from 6 a.m. to 10 p.m. must be limited to circulation for reason of work (including going from home to the work place(s) when work is essential and remote work is not possible, going shopping for first necessity items, assisting old / ill persons or in the vicinity of the domicile for physical activity or walking pets.
- For what is worth, we strongly advise you to provide and sign for all employees who continue to carry out their activity outside their domicile a statement certifying of their pursuing their activity and the working hours.
- The movement of persons outside their domicile from 10 p.m. to 6 a.m. is banned, unless a work reason or a personnel emergency are present, in this case, the concerned persons shall produce, upon demand of the authorities and as the case may be, either a company card or the certificate issued by the employer or a statement under sole responsibility.
The declaration under sole responsibility must provide for the name and surname, date of birth, the address of the domicile / the place of work, the reason of the voyage, the date and the signature. Such restrictions on the free movement shall enter into force starting with March 23 at 10 o’clock p.m.
WARNING ! Failure to comply with the emergency measures on free movement of persons entail disciplinary, civil, contravention or even criminal liability as under the provisions of the article 27 of the Emergency Ordinance of the Government no. 1/1999.
Access of the foreign citizens in Romania
- The access of the foreign and stateless citizens in Romania at the crossing points of the border is forbidden unless they are members of a Romanian citizens family, members of the family of citizens of other EU or EEE members or Swiss Confederation, residing in Romania, holders of a long stay visa, of a residence permit or of a document equivalent to such residence permit issued by the Romanian authorities;
- Are allowed to enter in Romania the persons travelling for work reasons (upon producing underlying documents such a visa, a residence permit or other equivalent) as well as the diplomatic or consular personnel, personnel of the international organizations, military personnel or persons likely to provide humanitarian help.
- Passengers in transit, to the extent they respect a well-established transit couloir, repatriated citizens under consular protection or passengers who travel for essential reasons (health or family) and the persons needing international protection or for other humanitarian reasons are granted access.
- The restrictions regarding the access in Romania are in force as of Sunday, March 22 at 10 p.m.
Commercial activity
- The commercial activity of the commercial centres, except for those in the food, veterinarian, pharmaceutical or cleaning services is temporarily suspended; pursuant to the Consummation Code, a commercial centre is deemed representing « the sale structure of middle or large surface where retail sale activity of products, merchant services and public food supply using common premises and adequate public services » ;
- The activity of dental offices is solely authorised for emergency cases;
- Any infringement of the provisions hereinabove shall constitute ground for disciplinary, civil, contravention or criminal liability.
ATTENTION : Commercial activities not to be pursued on grounds thereof are entitled to benefit from the tax incentives under the Emergency Ordinance no. 29/2020.
Other provisions
- The persons put on home isolation for preventing the spread of COVID-19 who leave the consignment place without the agreement of the competent authorities are deemed highly contagious and shall be escorted by law enforcement agents towards the places for institutionalised quarantine, under surveillance.
